Please read these Terms of Service ("Terms") carefully before using the Subconscious Scape Studio website and online store (the "Service") operated by Subconscious Scape Studio ("us", "we", or "our").

1. Acceptance of Terms & Eligibility
By accessing or using our Service, you agree to be bound by these Terms, including those additional terms and conditions and policies referenced herein and/or available by hyperlink.
By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority and have given us consent to allow any of your minor dependents to use this site. If you disagree with any part of the Terms, you may not access the Service.

2. Products, Orders, and Pricing Accuracy
  • Made-to-Order: All products sold through our Service are custom-produced on demand via our print partner, Gelato.
  • Order Rejection: We reserve the right to refuse or cancel any order at our discretion, including limiting quantities purchased per person, per household, or per order.
  • Errors and Inaccuracies: In the event that a product is mistakenly listed at an incorrect price or with incorrect information, we reserve the right to refuse or cancel any orders placed for that product, even if the order has been confirmed and your credit card charged. If your credit card has already been charged, we will issue a full refund for the incorrect amount.
  • Price Changes: Prices for our products are subject to change without notice.
3. Intellectual Property & Copyright Protection
All artwork, designs, text, images, logos, graphics, and content available on this site are the exclusive intellectual property of Subconscious Scape Studio.
  • You are granted a limited, non-transferable license to access the website for personal shopping use.
  • You may not reproduce, duplicate, copy, sell, resell, distribute, modify, or exploit any artwork or content without express prior written permission from us.
4. Returns, Refunds, and Cancellations
Your purchases are subject to our formal Return & Refund Policy.
Because our items are custom printed-on-demand:
  • We do not accept returns or exchanges for change of mind or customer sizing errors.
  • For items that arrive damaged, defective, or incorrect, you must contact us within 30 days of delivery with photographic evidence to receive a free replacement.
  • Cancellations and modifications are only guaranteed within 15 minutes of order placement due to automated fulfillment.
5. Shipping, Customs, and Risk of Loss
All items purchased from our Service are made pursuant to a shipment contract.
  • Transfer of Risk: The risk of loss and title for all physical items pass to you upon our delivery of the package to the shipping carrier.
  • Delays & Duties: Estimated shipping windows are guidelines and not guarantees. We are not responsible for delays caused by shipping carriers, severe weather, or customs processing. International customers are solely responsible for all customs duties, import taxes, and local fees.
6. User Comments, Feedback, and Reviews
If you post product reviews, submit photos, or send creative ideas/feedback to us (collectively, "Comments"), you grant us an unrestricted, royalty-free, perpetual, and irrevocable right to edit, copy, publish, and distribute those Comments in any medium. We are under no obligation to maintain Comments in confidence, pay compensation for Comments, or respond to Comments.

7. Third-Party Tools and Services
We utilize third-party platforms and integrations—including Shopify Inc. (which hosts our store) and Gelato (which fulfills our orders). You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations, or conditions of any kind. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

8. Prohibited Uses
In addition to other prohibitions set forth in the Terms, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (d) to submit false or misleading information; or (e) to upload or transmit viruses or any other type of malicious code.

9. Limitation of Liability & Indemnification
To the fullest extent permitted by law, Subconscious Scape Studio, our directors, officers, employees, or partners (including Gelato) shall not be liable for any indirect, incidental, punitive, special, or consequential damages of any kind—including lost profits, lost revenue, or replacement costs—arising from your use of the Service or any products procured using the Service.

You agree to indemnify and hold harmless Subconscious Scape Studio from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms.

10. Governing Law & Jurisdiction
These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the United States and the State of New York, without regard to conflict of law principles.

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates and changes to our website. It is your responsibility to check our website periodically for changes.
